Terms and Conditions

Article 1 Definitions
In these general conditions the following terms have the following meanings, unless otherwise indicated or the context otherwise requires:
a. Lief lifestyle South Africa: the user of these terms and conditions:
Cape Orange Intercultural Connections CC, operating as Lief! lifestyle SA and located at 2268 in Sun Valley, 7985 Cape Town South Africa and with info@cape-orange.com as email address;
b. Customer: any natural person that through the website (www.liefwebshop.co.za) enters into an agreement;
c. Agreement: the agreement between the customer and Lief! lifestyle SA;
d. product: the good(s) delivered by Lief! lifestyle SA;
e. Website: the website www.liefwebshop.co.za operated by Lief! lifestyle SA.

Article 2 General
2.1 Any exceptions to these general conditions are only valid if expressly agreed in writing or electronically.
2.2 If one or more stipulations in these general conditions are invalid or void, the remaining provisions of these general terms and conditions still apply. Lief! lifestyle SA and the customer will discuss new rules to replace the invalid or void provisions, of which, if possible, the purpose and intent of the original conditions are observed.

Article 3 Offers and Tenders
3.1 The range on the website may be changed. Changes in the range will only take place before the conclusion of the agreement.
3.2 On the website, in catalogs and mailings the images will be shown as closely as possible to match with reality. Typing errors are preserved.
3.3 The prices for the products offered are in Rands including VAT and excluding shipping.
3.4 Offers do not apply automatically to future assignments.
3.5 In the event of temporary promotions Lief! lifestyle SA is only liable for the action, according to these prices within the applicable limit for the action and always delivers as far as stocks are exhausted. If the product is sold within the promotion period or no longer within the promotion period can be provided, no claim for the special price can be made. Lief! lifestyle SA will explicitly state if an offer has a limited duration or is subject to conditions.

Article 4 Conclusion of agreement
4.1 The contract is concluded upon the acceptance of the customer of the offer and meets the corresponding conditions.
4.2 If the customer has accepted the offer electronically, Lief! lifestyle SA will confirm by email the receipt of the acceptance of the offer. Until receipt of such acceptance has not been confirmed, the customer may rescind the agreement.

Article 5 Price Change
5.1 If the prices of the products increase following the conclusion of the agreement, the customer is entitled to terminate the contract at the date the increase takes effect.
5.2 Price increases after the conclusion of the contract is permitted if the price increase is the result of an increase in VAT, currency fluctuations or any other legal measure.

Article 6 Supply and delivery
6.1 The delivery periods specified by Lief! lifestyle SA are not a deadline to be considered.
6.2 If the goods ordered cannot be delivered within 30 days after the order, Lief! lifestyle SA will contact the customer. In such a case, the client agrees on a new delivery or the customer may rescind the contract. If the customer cancels the agreement, Lief! lifestyle SA will refund the money paid within 30 days after the dissolution.
6.3 The ordered products are shipped to the address specified by the customer until the customer has given Lief! lifestyle SA a new address.
6.4 Lief! lifestyle SA will mention the amount of shipping costs separately, even though they will be indicated prior to the time of ordering online.
6.5 Once the products have been delivered at the destination to the customer, the risk for these products are transferred to the customer.

Article 7 Payment
7.1 Payment may be made in the following ways:
a. by bank transfer;
the client transfers directly in to the specified bank account of Lief! lifestyle SA
7.2 In the event of late payment, the customer will be in default, after Lief! lifestyle SA at least once mentioned the customer has to pay within reasonable time. In that case, the client will be liable for interest from that of the arrears until the date of payment. In addition the client also is liable for all legal fees.

Article 8 Complaints
8.1 Lief! lifestyle SA recommends to inspect the product(s) immediately upon receipt and report any failures within a reasonable period of time.

When reporting a complaint, the customer account number has to be provided to Lief! lifestyle SA.
8.3 Complaints are dealt with within 14 days. If settlement of a complaint is not possible within the period of 14 days, the client will be informed of this delay.
8.4 Should the returned product be faulty, Lief! lifestyle SA will either repair or replace or an amount will be credited. Lief! lifestyle SA will carry the costs associated with the repair or replacement of defective product(s).

Article 9 Warranty
9.1 For all products supplied by Lief! lifestyle SA a statutory warranty period of two months is applicable.
9.2 If damage or defects caused by a product:
a. normal wear and tear;
b. misuse;
c. lack of proper maintenance;
d. modifications or repairs by the customer or by third parties;
e. any government regulation regarding the nature or quality of the materials used,
the customer may not rely on the warranty.

Article 10 Force Majeure
In case of force majeure Lief! lifestyle SA can not be held liable for any damage, except and insofar Lief! lifestyle SA has benefited from the force majeure were they would not have benefited in any other normal performance.

Article 11 Ownership
11.1 All delivered and to be deliver products remain the exclusive property of Lief! lifestyle SA, until all claims Lief! lifestyle SA has or will have on the customer, are fully paid.
11.2 Until the ownership of the products to the customer is transferred, the customer may not pledge the goods or to give third parties any right thereto.

Article 12 Confidentiality
Both parties are obliged not to disclose any confidential information obtained during the course of their agreement of each other or from another source. Information is confidential if it is mentioned by the other party or when it arises from the nature of the information. The party that receives confidential information, will use it only for the purpose for which it has been provided.

Article 13 Intellectual Property Rights
13.1 The customer must treat all intellectual property rights, which are applicable on the Lief! lifestyle SA products, unconditionally.
13.2 Without the prior written or electronic consent of Lief! lifestyle SA, the customer may not use information, text, logos, trademarks, trade names and images he has obtained through the website, copy, forward, distribute, reproduce or publish.

Article 15 Personal details
15.1 Lief! lifestyle SA shall ensure that all personal data of the customer complies with the Protection Act.
15.2 Lief! lifestyle SA processes personal data (such as name, address, email address and telephone number) for the following purposes:
a. shipment of the ordered products;
b. managing a customer base.
15.3 Lief! lifestyle SA will never provide personal information to third parties unless the customer has given explicit permission.

Article 16 Security and the Internet
Lief! lifestyle SA take appropriate technical and organizational measures to protect the electronic transmission of data in case the customer has accepted an offer electronically. Lief! lifestyle SA will take appropriate security measures when the client pays electronically. In this context, Lief! lifestyle SA provides a secure web environment.

Article 17 Final provisions
17.1 Always applicable is the version of the General Terms and Conditions at the time of the conclusion of the agreement, unless the customer has accepted the revised version of the General Terms and Conditions.
17.2 The parties will only appeal to the courts after they have tried their utmost to resolve a dispute by mutual agreement.
17.3 All agreements between the customer and Lief! lifestyle SA are according to South African law.
